The rise of generative AI is driving a shift towards a more technical, standards-based approach to regulation, particularly in the EU. This talk argues that this risks moving information law away from one of its core purposes: protecting fundamental privacy rights within the digital space. Data protection law, in particular, has a hybrid character, functioning both as a form of digital market regulation and as an expression of the fundamental right to privacy.
